Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ShiftClub mobile application and related services (the "Service"), operated by SL Media Labs LLC ("ShiftClub," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@slmedialabs.com if you suspect unauthorized use of your account. You may create only one personal account, though business/Vendor profiles are permitted under Section 6 below.

3. Your Content

You retain ownership of the content you post to ShiftClub (photos, posts, comments, community threads and replies, Garage entries, Marketplace listings, etc.). By posting content, you grant ShiftClub a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and providing the Service.

You are solely responsible for the content you post and confirm that you have the right to share it.

4. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Harass, threaten, or abuse other users
• Post false, misleading, or fraudulent content, including misrepresenting a Marketplace listing
• Impersonate any person or entity
• Post content that infringes another party's intellectual property rights
• Attempt to circumvent our content moderation, reporting, or safety systems
• Use the Service for any commercial purpose not expressly permitted (see Section 5, Marketplace and Vendor accounts)

We may remove content, suspend, or terminate accounts that violate these Terms, at our discretion.

Content you submit, including community threads and replies, is also checked by automated moderation, including a third-party AI service, and by our staff, and may be rejected, hidden, or removed.

5. Marketplace

ShiftClub's Marketplace is a peer-to-peer classifieds feature for listing and browsing cars and parts.

• ShiftClub is not a party to any transaction. We do not process payments, provide escrow, verify listings, or guarantee the accuracy of any listing, the condition of any item, or that a seller actually owns the item listed. All transactions are completed entirely off-platform, at the sole discretion and risk of the users involved.
• No warranty of safety or outcome. While we provide general safety guidance and a reporting system, we do not guarantee the safety, legality, or successful completion of any transaction arranged through the Marketplace.
• Not allowed in the Marketplace. You may not list or ask for: weapons, firearms or ammunition; stolen goods; counterfeit or fake parts, or parts that infringe someone's trademark; illegal items or items that are unsafe or not legal for road use; vehicles or parts you do not own or are not entitled to sell; stolen or forged license plates, registration or identity documents; drugs; or anything offered as part of a scam or to take payment without delivering the item. We remove such listings and may ban the seller.
• Reporting and moderation. You can report listings or users that violate these Terms or our content policies. We may remove listings or take action against accounts at our discretion, but we are not obligated to resolve disputes between buyers and sellers.
• No listing fees currently apply to Marketplace transactions. See Section 6 for business (Vendor) profiles.

6. Vendor (Business) Profiles

A Vendor profile lets a business show its name, description, address, and country/state, and list products. ShiftClub does not currently charge for Vendor features or sell subscriptions, and no payment arrangements for Vendor features exist. Vendor features, such as a higher listing limit or a verification badge, are set by ShiftClub and may change or be withdrawn.

• No guaranteed outcome. Vendor status, badges, and feed-priority features do not guarantee sales, visibility, or any particular result — they are informational/promotional features only, and may change over time.

7. Communities

Any user aged 18 or older may create up to 3 private communities. The person who creates a community is responsible for its rules and for the content shared in it. These Terms and ShiftClub's moderation still apply inside every community. We may remove, restrict or suspend a community, including a private one.

8. Enforcement

We have zero tolerance for objectionable content and abusive users. We may remove content and suspend or ban accounts, and for serious violations we may do so without notice. If you think we made a mistake, you can appeal by emailing support@slmedialabs.com.

9. Intellectual Property

The ShiftClub name, logo, and related branding are the property of SL Media Labs LLC. Nothing in these Terms grants you any right to use our trademarks without prior written permission.

10. Third-Party Services

The Service relies on third-party providers, including Supabase, Cloudflare, Expo, Apple (sign-in and push notifications on iOS), Google (sign-in, Firebase Cloud Messaging, and location lookups), OpenAI, Resend, OpenStreetMap, and LocationIQ (the rounded pin of public, pinned, approved meets is sent to LocationIQ for address lookup). Our Privacy Policy explains what each one receives. Your use of certain features may also be subject to those providers' own terms.

13. Indemnification

You agree to indemnify and hold harmless SL Media Labs LLC from any claims, damages, or expenses arising from your use of the Service, your content, your conduct, or any Marketplace transaction you engage in.

14. Termination

You may stop using the Service and delete your account at any time, in the app (Settings › Delete account), on the website while signed in, or with our web account-deletion form; the Privacy Policy explains what happens to your data. We may suspend or terminate your access to the Service, with or without notice, for conduct that violates these Terms or is otherwise harmful to ShiftClub, other users, or third parties.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. If you are located outside the United States, you may have additional rights under the mandatory laws of your country that this section does not override.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
